General Terms and Conditions
Terms and Conditions
This Terms and Conditions document governs the use of SelectTel’s Website and the provision of SelectTel’s telecommunications services. Please read this Agreement carefully. Your use of the Services provided by SelectTel will constitute your agreement to comply with these rules. SelectTel may amend or replace these Terms and Conditions from time to time.
Use of the Website by You
Your right to use the Website is personal to you and you are responsible for all of your own use of the Website. You may not down load, modify, transmit, or otherwise use any material from the Website for public or commercial purposes. You are responsible for your own network and connection charges.
Other than connecting to SelectTel’s servers by HTTP requests using a web browser, you may not attempt to gain access to SelectTel’s servers by any means – including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Website or otherwise. You agree not to disrupt, modify or interfere with the Website or its associated software, hardware and servers in any way and you agree not to impede or interfere with others’ use of the Website. You further agree not to alter or tamper with any information or materials on, or associated with, SelectTel and/or the Website.
Your obligations to us
When you use services provided by SelectTel you must follow our instructions and make sure all information given is correct and complete. You must not use our services for unlawful purposes or interfere with the provision and use of our services by other customers. You must not resell or rebill our services without our written approval.
Service Obligations & Liability
We are not obliged to provide services unless we accept your application. We can decide whether or not to accept any application. SelectTel will endeavour to provide a highly reliable 24x7 service to its customers. However SelectTel does not guarantee that the service will be continuous or fault-free at all times. Under no circumstances shall SelectTel or any of its subcontractors or agents be liable to customers for special, incidental, indict or consequential damages as a result of a non-continuos service, or for any loss, damage or any expense directly or indirectly arising from a customer’s use or inability to use SelectTel’s services or for commercial loss of any kind, including costs of procurement of substitute services, loss of profits, and interruption of services.
Privacy Policy
SelectTel is committed to protecting your privacy. We will not collect any information about individuals, except where it is specifically and knowingly provided by them. The information collected will be used to send you the information you have requested and to help us develop the site to be useful to you. We may share non-personal statistics about our customers and traffic patterns with partners or other parties. However, we do not sell or share any information about individual customers
The Website may also place cookies on your computer. These are only accessible by us and will only be used to track the pages of web sites visited by you, in order for us to build a better site more tailored to your needs and interests. Our cookies do not record personal information about you, merely your computer.
We may from time to time email you with special offers or deals. This service is completely discretionary. If you decide you no longer wish to receive the newsletter, just follow the unsubscribe instructions contained within the email.
When you click through to link with other web sites you leave the area controlled by SelectTel. We cannot therefore accept responsibility for any issues arising in connection with either their use of your data, the site content or the services offered to our customers by these sites.
In addition to SelectTel's safeguards your personal data is protected in New Zealand by the Privacy Act. You have the right to see what is held about you and correct any inaccuracies.

The general information about SelectTel Communications Ltd and the products and services they offer contained on this Website has been prepared solely for the purpose of providing information about SelectTel and the services and products they offer. While SelectTel takes reasonable care to provide information which is accurate and up to date when it is first included on the Website it does not undertake to update or correct such information. SelectTel reserves the right to change, delete or move any of the material on the Website at any time without notice.
SelectTel makes no representation or warranty express or implied as to the accuracy or completeness of any of the information included on the Website. Neither SelectTel nor any other person or entity accepts liability for any loss of whatsoever nature nor howsoever caused, arising directly or indirectly from the use of or reliance upon the Website or any of the information it contains.
You acknowledge that SelectTel has not reviewed and does not endorse the content of any or all sites linked to or from the Website and is not responsible for the content or actions of any other sites linked to or from the Website. Linking to any other service or site from the Website is at your sole risk.
SelectTel shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to access the Website. This includes viruses alleged to have been obtained from the Website, your use of or reliance on the Website or any of the information or materials available on the Website, regardless of the type of claim or the nature of the cause of action.
Pre-Pay Phone Call Services Terms and Conditions
SelectTel Pre-Pay Service
By using the SelectTel Pre-Pay services you agree to the following additional Terms and Conditions:
SelectTel will debit call charges against the credit balance on the customer’s Account. Charges for Services may vary according to Account type and may change from time to time without notice. SelectTel will endeavour to keep service pricing current on our website. Pricing is also available from Customer Services. Different charges apply depending on whether calls are made via a local access number or a toll free number.
Please also note:
- Calls can be made by anyone who knows the Account number and PIN (if applicable). Therefore the Customer should keep the Account number and PIN number confidential to prevent misuse and should protect the card as securely as cash. SelectTel does not re-issue PINs if lost or forgotten.
- Your account has no cash value and is non-refundable
- Your account is valid for six months from date of last use.
- Call records shown as used on the account are agreed by the Customer to be final proof of calls made and call duration.
- Local and International calls terminating to cellular networks may be charged at a higher rate than that listed, unless otherwise indicated with a specific rate
- Calls are rounded to 1 minute increments
- Automated service and live customer service is available for all inquires. Live customer service is subject to stated business hours
- All charges are subject to GST
- If credit card recharge is offered then Visa and Mastercard credit cards only are accepted. At time of credit card recharge all details of the transaction will be recorded. Any person making unauthorised use of credit cards will be prosecuted to the full extend of national and international law. If SelectTel has reasonable grounds for suspicion that a credit card transaction is fraudulent, then SelectTel has the right to terminate the Account without notification.
- If we terminate your account for any breach of service by you, then no refund is payable to you unless we agree otherwise.
SelectTel is not responsible for:
- Use of a person’s Account by another person
- Refunds for lost or stolen Account numbers
- Refunds for lost or forgotten PINs
- Refunds for Accounts or correspondence mailed to customer’s last known address
Pay-Later Services
- SelectTel Commitment
We will always do our best to make sure that you receive reliable and high-quality services but cannot guarantee that our services will always operate free of faults. If you do encounter a problem please contact Customer Services and we will work to restore the service as soon as possible.
- The Customer Commitment
In return for providing the services to you, you agree to:
- pay for all the services that we provide to you and charge to your account (even if somebody else uses those services) by the due date shown on your bill;
- follow our reasonable instructions about using the services;
- only use the services for the purpose for which they are provided;
- not use the services in any way that is unlawful or could interfere with our network, any other operator's network or with another customer's enjoyment of our services
- You will make sure that all information you give to us is complete and accurate; this includes advising us promptly if you change premises or postal address. It is important that you contact us before you move - otherwise you will still be responsible for paying for the services that we provide to your old address.
- Term Agreement & Commencement of Services
If a term Agreement is stated then the Agreement commences on the date it is signed by both parties and will continue until terminated in accordance with this Agreement. We will begin providing Services to you in accordance with the timeframe that the parties agree in writing or, if no timeframe is agreed, within a reasonable time.
- Charges for Services
Current services and charges are available by visiting our website www.selecttel.co.nz or by calling Customer Services. From time to time we may decide to change some of our charges.
- Paying SelectTel’s Invoice
We will send you an invoice by email at regular intervals. It is important you tell us straightaway about any change to your postal or email address. Some charges may be billed in advance. Sometimes charges will not show on your bill until some time after the month in which they were incurred. You will still be liable for such charges. Should there be a mistake in the invoice and we agree that we have made a mistake then we will correct the bill immediately. If we find that there is no mistake and the due date for payment has already passed, you agree to pay your bill straight away. If you have not contacted us before the due date shown on your bill then you agree to pay the full amount by that date. You must pay each invoice within 14 days of the invoice date. If you do not pay any invoice within that time we may charge you interest on the overdue amount from the due date until the date you pay, at the rate of 1.5% per month (with a minimum charge of $10); and recover from you any debt recovery costs. Part payment of your bill will not amount to a full and final settlement unless we have agreed to this in writing.
- Credit checks
We may decide to use information that you give us in order to check your creditworthiness at any time. You agree that we may pass on your information to third parties so that they can run credit checks on our behalf. You may have to pay us a deposit before you can use, or continue to use, our services.
- Termination
We may stop providing any Service or terminate this Agreement after the expiry of the Initial Term (if any) by giving you 30 days notice in writing. You may give up any Service or terminate this Agreement at any time, by giving us 30 days notice in writing. If you give up any Service or terminate this Agreement or we terminate all or part of this Agreement prior to the expiry of the Initial Term (if applicable), then we may require you to pay an amount equal to the value of the fixed Charges that would have otherwise been payable from the date of termination to the end of the Initial Term; and if we have agreed to waive a set-up charge, the amount of that set-up charge multiplied by the number of months remaining in the Initial Term at the date of termination divided by the total number of months in the Initial Term
If you have a no-term Agreement with us for the supply of services, then you may ask us to stop a particular service or cancel this whole Agreement at any time and for any reason by giving us 14 working days notice. You can do this by contacting Customer Services. If you have been paying for a service in advance, however, then we may choose not to stop that service until the end of your current billing period or minimum subscription period, as the case may be.
We may stop or suspend a particular service or cancel this whole Agreement (whether a term or non-Term Agreement) at any time and without telling you if:
- you do not pay for any of our services by the due date shown on your bill;
- you give us incorrect information;
- you have not given us a deposit we have asked for; or
- you have not kept to these terms and conditions.
We may stop or suspend a particular service or cancel this whole agreement at any time and for any other reason so long as we have tried to tell you in advance. If either of us cancels this agreement for any reason you will be liable for any applicable early disconnection fees and you will still have to pay for all services that we provide to you up until the effective date of cancellation.
- Consumer Guarantees
If we are providing services to individuals then you can exercise your rights under the Consumer Guarantees Act 1993 at any time unless you use, or have indicated you will use, our services for business purposes, in that case the Consumer Guarantees Act 1993 does not apply.
- Our Liability to you
To the extent allowable by law, we will not be liable for any special, indirect or consequential loss or loss of profits that you incur as a result of anything we have done or not done.
- Transferring this Agreement
We can transfer some or all of our rights and obligations under this agreement. If we do this we will try to tell you in advance. You agree not to transfer any of your rights and responsibilities under this agreement to anyone else.
- Dispute Resolution
A party claiming a dispute has arisen is to give written notice to the other party specifying the nature of the dispute. On receipt of that notice, the parties will use all reasonable endeavours to resolve the dispute by discussion, negotiation or other informal means. If the parties do not resolve the dispute within 10 Working Days of the receipt of the notice then either party can, by writing to the other, require that the dispute be mediated in accordance with the standard mediation agreement of LEADR New Zealand Incorporated (Lawyers Engaged in Alternative Dispute Resolution), and the Chair of LEADR will select the mediator and determine the mediator's fee.
- Notices
Any notice given pursuant to this Agreement must be in writing and be delivered, or sent by post or courier to the other party's contact address, as set out below.
